Right of Withdrawal
Overview
EU consumers normally have a 14-day right to withdraw from distance purchases without giving a reason. For Sparktale products two special rules of the EU Consumer Rights Directive (in Austria: FAGG, in Germany: §312g/§356 BGB) apply, explained below.
Digital edition (instant unlock)
The digital edition is digital content delivered immediately. Before you pay, we ask for your express consent to immediate delivery and your acknowledgement that you thereby lose the 14-day right of withdrawal (Art 16(m) of the Directive). If you do not give this consent, the purchase cannot be completed. If digital content was ever supplied to you without that consent, your withdrawal right remains intact and you can use the form below.
Printed personalised books
Printed books are produced to your personal specification (your child’s name, photos and story). Under Art 16(c) of the Directive there is no statutory right of withdrawal for such made-to-order goods. We tell you this before you order. Independently of this, our voluntary 48-hour cancellation policy and our replacement/refund promise for defective books (see Terms) continue to apply.
How to withdraw
Where a right of withdrawal exists, you can exercise it within 14 days of the day of contract (digital content) or delivery (goods) by a clear statement — an email to [email protected] is sufficient. You may use the model form below, but you do not have to. If you withdraw, we refund all payments received from you for that purchase without undue delay and at the latest within 14 days, using the same means of payment you used.
